Cursing the Companions

Ibn Hazm mentions in ‘al-Muhala’ (13/504) with a chain up to Imam Malik that he said:

‘Whoever curses Abu Bakr and Umar then he is to be whipped, and the one who curses Aeysha is given capital punishment [by the Muslim Ruler].’

 

It was asked of him: ‘Why is capital punishment given regarding Aeysha?’

Imam Malik said: ‘ because Allaah Ta’ala said:

يَعِظُكُمُ اللَّهُ أَنْ تَعُودُوا لِمِثْلِهِ أَبَدًا إِنْ كُنْتُمْ مُؤْمِنِينَ

<< Allaah forbids you from it and warns you not to repeat the like of it forever, if you are believers. >>

[Noor: 17]

Imam Malik said:

‘Because indeed anyone who accuses her, has opposed the Qur’aan, and whoever opposes the Qur’aan is given capital punishment.’

Ibn Hazam said:

‘The statement of Malik here is correct, and this is complete apostasy, and it is belying Allaah Ta’ala that He completely freed her from this accusation.’

سب الصحابة

‏ساق ابن حزم في المحلى(٥٠٤/١٣) بإسناده إلى الإمام مالك أنه قال:

من سب أبا بكر وعمر جلد، وسب عائشة قتل. قيل له: لم يقتل في عائشة؟ قال: لأن الله تعالى يقول: (يعظكم الله أن تعودوا لمثله أبدا إن كنتم مؤمنين).

 

قال مالك: فمن رماها، فقد خالف القرآن، ومن خالف القرآن قتل.

قال ابن حزم: قول مالك هنا صحيح، وهي ردة تامة، وتكذيب لله تعالى في قطعه ببراءتها.
