مَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ

Whoever does not Judge with what Allaah has Revealed by Shaykh, the Muhaddith, Rabee’ ibn Haadee al-Madkhalee

The Saying of Allaah Ta’ala:

وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ

<<  And whosoever does not judge by what Allaah has revealed, such are the Kafiroon (i.e. disbelievers – of a lesser degree as they do not act on Allaah’s Laws ).>>  [Maidah : 44]

The Shaykh was asked :

‘Does the person who rejects the Tafseer of Ibn Abbas regarding the saying of Allaah Ta’ala:

وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ

<<  And whosoever does not judge by what Allaah has revealed, such are the Kafiroon (i.e. disbelievers – of a lesser degree as they do not act on Allaah’s Laws ).>> [Maidah : 44][1] and says that the Ayaah is general and it is not allowed to limit it and says that the ruler who rules without what Allaah has revealed is a Kaffir absolute, is this person considered to be from the Khawarij[2]?’

The Answer:

‘There is no doubt that this is the way of the Khawarij. Therefore, whoever opposes the Imams of Tafseer – at the head of them is Ibn Abbas –  and opposes the Imams of Hadeeth and the Sunnah, and the Imams of Aqeedah (Belief) and Manhaj (Methodology) in the issues of dangerous rulings and these great principles, then no doubt he has chosen a way other than the path of Ahl-ul-Sunnah wal-Jammah and a Manhaj other than the Manhaj of Ahl-ul-Sunnah wal-Jammah and a Manhaj other than the Manhaj of those firmly grounded in knowledge.

So it is obligatory upon these people [the Khawarij] to repent to Allaah Ta’ala.

Ibn Abbas is the explainer of the Qur’aan and the scholar of this Ummah. The senior Companions would accept his decision, they would accept him being an Imam and his understanding of the Deen of Allaah -Azza wa Jal- may Allaah be pleased with him.  The renowned Imams of Islaam continued upon Ibn Abbas’ methodology, but the Khawarij opposed him in the Tafseer of this Ayaah and other Ayaat.

It is not strange that the people of Bida’ would oppose the Companions, but rather they opposed the Book and the Sunnah. Yes, I remind you that the Messenger sallAllaahu alayhi wa sallam described the Khawarij that they are ‘young with foolish intellects’[3] do you understand. Those who interpret these explanations nowadays have foolish intellects and are young.

The Messenger sallAllaahu alayhi wa sallamsaid:

هَلاَكُ أُمَّتي عَلى يَدَيْ أُغَيْلِمَةٍ سُفَهاءَ الأحْلامِ

‘The destruction of my Ummah will be at the hands of youth with foolish intellects.’

Nowadays they say, the youth, the youth, the awakening, but they have destroyed the Ummah, they have entered it into continuous misguidance of belief, in Ahkaam (rulings), taking the blood of the people, their wealth, they have destroyed the Ummah religiously and worldly.

Some hold the view that this hadeeth is applicable to the Bani Ummayyah, however, I hold the opinion that this hadeeth combines with the hadeeth of the description of the Khawarij that they are ‘young with foolish intellects’, so even if this hadeeth can be extended to some of the youth from the Quraish it can still apply to other than them, since this unites with the hadeeth of the description of the Khawarij that they are young with foolish intellects.

Their intellects are feeble and foolish, and from their foolishness is that they do not care about the Tafseer of the Companions, or with the Fiqh (understanding) of the Companions, or the Fiqh of the scholars of the Ummah, or of the Imams of the Ahl -ul- Sunnah, they opposed their path, rather we say they followed the way of the Khawarij whom the Messenger sallAllaahu alayhi wa sallamcharacterised them with being young with foolish intellects.

The scholars said: youth, and [the word youth in Arabic] applies to the person who has a deficient intellect and Deen, and this is clearly their description.

So we ask Allaah to pardon and protect the Ummah from their evil.  The scholars according to them are labelled as spies, employees [of the rulers] etc.

They push the people away from the scholars and link them up to those with foolish intellects and the youth and to the Imams of Bida’ and misguidance from the Khawarij and the Rawafida.’

[3] Narrated by ‘Alee who said: If I tell you a narration from the Messenger of Allaah -sallAllaahu alayhi wa sallam- I swear by Allaah that, it is more beloved to me that I fall down from the sky than ascribe a lie to him, but if I tell you something between me and you then indeed there is trickery in war.

No doubt I heard Allaah’s Messenger saying, ‘During the last days there will appear some young foolish people who will say the best words but their faith will not go beyond their throats[3] and they will go out from (leave) their religion[3] as an arrow goes out of the game.

So, where-ever you find them, kill them, for who-ever kills them shall have a reward on the Day of Resurrection[3].’[3]

Ibn Hajr said: it means that they had evil minds.

An-Nawaawee said: It means they will be young and have small minds.

Ibn Hajr said: they believe in it by reciting it, but do not believe in it by their hearts.
