3 – At the Time of Slaughtering an Animal

Translated

By

Abbas Abu Yahya

From Rafai bin Khadeej  from the Prophet –sallAllaahu alayhi wa Salam– that he said:

‘The animal which is slaughtered and Allaah’s name is mentioned at that time then eat it, do not slaughter it using a tooth or a claw/finger nail. As for a tooth then that is similar to a bone and a claw/finger nail is an Ethiopian knife.

[Collected by Bukhari & Muslim]

What is the meaning of the saying of the Messenger –sallAllaahu alayhi wa Salam–: ‘’The animal which is slaughtered and Allaah’s name is mentioned at that time then eat it, do not slaughter it using a tooth or a claw/finger nail. As for a tooth then that is similar to a bone and a claw/finger nail is an Ethiopian knife.’  what is the meaning here of tooth and claw/finger nail?

Shaykh Al-Albaani answered:

‘The origin of slaughtering according to the Sharia is to slaughter with a  knife; a sharp, razor edged knife which would give ease to  the animal to be slaughtered, that is the foundation.

However, sometimes it may not be easy for the slaughterer  to find a sharp, razor edged knife, in fact it may not be easy for him to find a metal weapon. Then here the situation is that he takes a rock which has a sharp edge similar to a knife, by which he can slaughter and let out the blood. Therefore, here the slaughtered animal would be Halal.

As for the point of it being ease for the person slaughtering an animal, and he does not have a sharp knife, then he is not prevented from slaughtering in this the situation.  But from other Ahadeeth which are connected to truly being gentle with animal, the matter is conclusive and is mentioned clearly in the hadeeth of Muslim which is the statement of the Messenger -alayhi as-Salat wa Sallam: ‘When you fight, fight well, when you slaughter, slaughter well and make sure you sharpen your blade and give ease to the animal to be slaughtered.’

Therefore, giving ease to the animal is an order which is commanded by the Sharia, and it is from gentleness to animals what Islaam came with rather than what all the people have brought.  It is not allowed to slaughter using a tooth meaning a bone nor a claw/finger nail in place of a sharp rock. Long sharp finger nails have become modern day fashion for some women and perhaps for some men that they lengthen their finger nails like predatory animals. It is not allowed according to the Sharia to slaughter an animal with a tooth, and what dispenses with that is a very sharp rock. The scholars and explainers of Hadeeth say that when the Prophet –sallAllaahu alayhi wa Salam– exempted slaughtering with a rock, the impermissibility of doing so with a tooth or a bone was because slaughtering with these two things was a matter that the people in the land of Ethiopia were accustomed to, so the Prophet –sallAllaahu alayhi wa Salam– prohibited this for two reasons, the first of which is a general rule that a Muslim should not resemble the non-Muslim.  The second matter is that the intent when slaughtering is to give ease to the slaughtered animal and this cannot occur by slaughtering with a bone or finger-nail.’
