The Intent of the Word ‘Kufr’ in the Ayaah
وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللَّهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ
<< And whosoever does not judge by what Allaah has revealed, such are the Kafiroon (i.e. disbelievers – of a lesser degree as they do not act on Allaah’s Laws ).>> [Maidah : 44]

Question : this question is about the statement of Allaah Ta’ala : << And whosoever does not judge by what Allaah has revealed, such are the Kafiroon (i.e. disbelievers – of a lesser degree as they do not act on Allaah’s Laws ).>> Is this Kufr major or minor?
Shaykh Muhammad bin Haadee al-Madkhalee answered :
‘No, this is a lesser disbelief, as is mentioned in the hadeeth of Ibn Abbas -Radhi Allaahu anhumma- this is what the majority of the scholars say, even though this does not impress the Takfiris (those who excommunicate Muslims), those who go around bombing, blowing things up and those whom they call terrorists nowadays. It is not important to us what they call them because in reality they are the Khawarij (renegades).
This [a lesser kufr] is a text from Ibn Abbas -Radhi Allaahu anhumma- and this is what the Companions of the Messenger -Radhi Allaahu anhumm- were upon.
The Companions criticised and refuted the Khawarij because they relied upon this Ayaah and made Takfeer of the Companions of the Prophet –sallAllaahu alayhi wa sallam– so it is not a strange issue that their inheritors today make Takfeer of us.
If the predecessors of these people used to make Takfeer of the Companions of the Prophet –sallAllaahu alayhi wa sallam– with this Ayaah, as Abdullaah bin al Abbas and Ibn Umar mentioned :
‘They relied upon Ayaat which were revealed about the disbelievers and they would -and this is the issue- apply it to the people of Islaam.’ So these people [nowadays] are their inheritors so it is not found to be strange that these people would make Takfeer because their predecessors indeed made Takfeer of the Companions of the Messenger of Allaah –sallAllaahu alayhi wa sallam– so are we compared to the Companions of the Messenger of Allaah –sallAllaahu alayhi wa sallam.
