Is it permissible in the Sharia to refrain from treating a sick person who the doctors have decided that it is not possible to cure him ?
The Answer: This is detailed, and the fiqh committee of Makkah of which I was the head of, researched this matter.
The scholarly brothers researched this matter and clarified that it is obligatory upon those responsible to treat and have a concern and care for a patient according to their abilities.
If the doctors know that there is no benefit in treating the patient and that medication does not benefit or help, then there is no problem of leaving that patient and not treating him, because the aim from medication is to benefit the patient.
Therefore, if it is known directly from doctors that this Medication does not help or benefit, and in fact could be harmful then no treatment is given and he is left to the command of Allaah, except if the doctors find something which aids him to live, or benefits him, then they should help him: Whether it is from medication, or an injection, or cryotherapy freezing parts of the muscle tissue, or other Matters which are known from treatment. Whereas if according to their knowledge medication does not benefit then it is no problem in leaving the patient.

هل إيقاف العلاج عن المريض الذي يُقرّ الأطباء عدم إمكانية شفائه جائز شرعًا أم لا؟
الجواب:
هذا فيه تفصيل، قد درسه المجمع الفقهي بمكة برئاستي، درسه الإخوان العلماء وبيَّنوا أنه يجب العلاج والعناية حسب الطاقة على المسؤولين، وإذا علموا أنه لا فائدة في الطب، وأن الدواء لا ينفع ولا يفيد؛ فلا بأس أن يتركوه ويدعوه؛ لأن المقصود من الدواء الفائدة، فإذا عُلم من الأطباء المباشرين أن هذا الدواء لا يُفيد ولا ينفع، بل قد يضرّ فلا….. ويُترك لأمر الله، إلا إذا وجدوا شيئًا يُعين على الحياة، أو ينفع بنفسه، فليفعلوا: من شرابٍ، من إبرٍ، أو من تبريدٍ، أو غير هذا مما يُعرف، أما إذا كان حسب علمهم لا يفيد؛ فلا بأس بتركه.

کیا ایسے مریض کا علاج روکنا شرعاً جائز ہے یا نہیں جس کے بارے میں ڈاکٹروں نے فیصلہ کیا ہو کہ اس کا شفا ممکن نہیں ہے؟
جواب:
اس بارے میں تفصیل ہے، اس مسئلے کو مکۃ المکرمۃ کی المجمع الفقہی الاسلامی نے میری صدارت میں زیر بحث لایا، ہمارے علماء کرام بھائیوں نے اس کا جائزہ لیا اور یہ واضح کیا کہ ذمہ دار افراد پر لازم ہے کہ وہ اپنی پوری استطاعت کے مطابق علاج اور دیکھ بھال کریں، لیکن اگر انہیں یہ معلوم ہو جائے کہ علاج کا کوئی فائدہ نہیں ہے اور دوا کا کوئی نفع اور فائدہ نہیں ہے، تو اس کو چھوڑنے اور ترک کرنے میں کوئی حرج نہیں ہے؛ کیونکہ دوا کا مقصد فائدہ پہنچانا ہے، پس جب معالج ڈاکٹروں سے یہ معلوم ہو جائے کہ یہ دوا فائدہ مند اور نفع بخش نہیں ہے بلکہ نقصان دہ ہوسکتی ہے۔۔۔۔۔۔ تو اسے چھوڑ کر اللہ کے حکم کے سپرد کر دینا چاہیے، البتہ اگر انہیں کوئی ایسی چیز مل جائے جو زندگی میں معاون ہو، یا بذات خود فائدہ مند ہو، جیسے شربت، انجکشن، یا کسی قسم کا تبریدی علاج وغیرہ، تو اسے استعمال کریں، لیکن اگر ان کے علم کے مطابق اس کا کوئی فائدہ نہ ہو تو اسے چھوڑنے میں کوئی حرج نہیں ہے۔
